INFORMAZIONI GENERALI
Le presenti Condizioni Generali di Vendita hanno per oggetto l’acquisto di opere d’arte realizzate dal venditore effettuato a distanza tramite rete telematica sul sito appartenente Ferenc Legyek / Les Vedettes di Simona Erba, con sede a Milano, Via Pelagio Palagi, 5, 20129.
Ogni operazione di acquisto sarà regolata dalle disposizioni di cui al DLgs. 185/99, DLgs. 206/05; le informazioni dirette alla conclusione del contratto saranno sottoposte all’art. 12 del DLgs. 70/03 e, per quanto concerne la tutela della riservatezza, sarà sottoposta alla normativa di cui al DLgs. 196/03.

CONCLUSIONE DEL CONTRATTO E ACCETTAZIONE DELLE CONDIZIONI GENERALI DI VENDITA. contratti di vendita dei prodotti sul sito si considerano conclusi al momento in cui perviene l’ordine di acquisto effettuato dal cliente a Ferenc Legyek / Les Vedettes di Simona Erba e quest’ultimo lo accetta.
Ferenc Legyek / Les Vedettes di Simona Erba, invierà tempestivamente al cliente ricevuta dell’ordine di acquisto effettuato dal cliente.
Il cliente, con l’invio telematico del proprio ordine d’acquisto, dichiara di aver preso visione e di aver accettato le presenti condizioni generali di contratto e si obbliga ad osservarle e rispettarle nei suoi rapporti con Ferenc Legyek / Les Vedettes di Simona Erba.

OBBLIGHI DEL CLIENTE
Il Cliente è tenuto, prima di inoltrare il proprio ordine d’acquisto, a leggere accuratamente le presenti condizioni generali di vendita.
L’inoltro dell’ordine di acquisto implica la loro integrale conoscenza e la loro accettazione.
Il Cliente è tenuto, infine, una volta conclusa la procedura d’acquisto on-line, a stampare e conservare le presenti condizioni generali di vendita, già visionate ed accettate durante la fase di conclusione del contratto.

DEFINIZIONE DELL’ORDINE
Con l’invio dell’ordine on-line, il Cliente trasmette a Ferenc Legyek / Les Vedettes di Simona Erba una proposta di acquisto del prodotto e/o dei prodotti inseriti nel carrello.
Quando il Cliente effettua un ordine on-line per i prodotti che ha inserito nel carrello, accetta di acquistarli al prezzo e ai termini indicati nelle presenti Condizioni Generali di Vendita.
Ferenc Legyek / Les Vedettes di Simona Erba comunicherà al Cliente l’ accettazione e la conferma dell’ordine.

MODALITA’ D’ACQUISTO
Il cliente acquista il prodotto, le cui caratteristiche sono illustrate on-line, al prezzo ivi indicato a cui si aggiungono le spese di consegna precisate sul sito.
Prima dell’inoltro dell’ordine di acquisto viene riepilogato il costo unitario di ogni prodotto prescelto, il costo complessivo in caso di acquisto di più prodotti e le relative spese di consegna.
Una volta inoltrato l’ordine di acquisto, il cliente riceverà da Ferenc Legyek / Les Vedettes di Simona Erba, un messaggio di posta elettronica attestante conferma di avvenuta ricezione dell’ordine di acquisto e contenente le informazioni relative alle caratteristiche principali del bene acquistato, l’indicazione dettagliata del prezzo, dei costi di consegna, dei tributi applicabili e dei mezzi di pagamento e contenente un rinvio alle condizioni generali di contratto e alle informazioni circa l’esistenza del diritto di recesso, alle condizioni e alle modalità del suo esercizio visualizzate sul sito. A seguito dell’approvazione del Decreto Legge 4 luglio 2006 n. 223 “manovra bis” Art. 37 commi 8 e 9, convertito con la Legge 248 del 4 agosto 2006, entrata in vigore il 12 agosto 2006, con cui viene ripristinato l’obbligo di comunicazione dell’elenco clienti e fornitori in caso di emissione fattura, e del Decreto Legge 78 del 31 maggio 2010 convertito in Legge 122 del 30 luglio 2010, impone la necessità di richiedere ai clienti di comunicare PARTITA IVA e CODICE FISCALE negli appositi campi presenti sul sito.

PAGAMENTO
Il cliente può effettuare il pagamento tramite carta di credito attraverso PayPal, con procedura idonea ad assicurare la riservatezza dei dati forniti dai clienti. Per ogni informazione e ulteriori Accordi Legali si rimanda il Cliente a consultare il sito www.paypal.com.

CONSEGNA DEI PRODOTTI
Il bene acquistato, unitamente alla relativa fattura, è consegnato tramite corriere all’indirizzo specificato dal Cliente al momento dell’ordine on-line.
Eventuali esigenze specifiche dovranno essere prospettate dal cliente a Ferenc Legyek / Les Vedettes di Simona Erba.
Nel caso di mancato recapito per assenza del destinatario, all’indirizzo da lui indicato nell’ordine, il corriere lascerà un avviso e riproverà una seconda volta; se il destinatario risultasse ancora assente, la merce verrà riconsegnata al mittente.

GARANZIA DI CONFORMITA’ E PRODOTTI DIFETTOSI
Il Venditore garantisce la conformità delle opere alle fotografie rappresentative delle stesse, salvo che il colore può subire variazioni legate alla risoluzione degli schermi dei clienti.
Il cliente ha tempo giorni tre dalla consegna dell’opera d’arte per segnalare eventuali difetti.
In caso di difetti, il consumatore potrà chiedere senza spese, alle condizioni di seguito indicate, la sostituzione del bene acquistato, a meno che la richiesta non risulti oggettivamente impossibile da soddisfare ovvero risulti per Ferenc Legyek / Les Vedettes di Simona Erba, eccessivamente onerosa ai sensi dell’art. 130, comma 4, del Codice del Consumo.
La richiesta dovrà essere fatta pervenire in forma scritta, a mezzo raccomandata con ricevuta di ritorno o tramite posta elettronica certificata a Ferenc Legyek / Les Vedettes di Simona Erba, la quale indicherà la propria disponibilità a dar corso alla richiesta, ovvero le ragioni che gli impediscono di farlo, entro sette giorni lavorativi dal ricevimento.
Nella stessa comunicazione, ove Ferenc Legyek / Les Vedettes di Simona Erba abbia accettato la richiesta del consumatore, dovrà indicare le modalità di spedizione o restituzione del bene nonché il termine previsto per la sostituzione del bene difettoso.

DIRITTO DI RECESSO
L’Acquirente ha in ogni caso il diritto di recedere dal contratto stipulato, senza alcuna penalità e senza specificarne il motivo, entro il termine di 14 (quattordici) giorni lavorativi, decorrente dal giorno del ricevimento del bene acquistato.
Nel caso l’Acquirente decida di avvalersi del diritto di recesso, deve darne comunicazione al venditore a mezzo di raccomandata con ricevuta di ritorno all’indirizzo: Les Vedettes di Simona Erba, Via Pelagio Palagi, 5, 20129 Milano, e tramite posta elettronica all’e-mail simona@ferenclegyek.com, La riconsegna del bene dovrà comunque avvenire al più tardi entro 30 (trenta) giorni dalla data di ricevimento del bene stesso.
In ogni caso, per aversi diritto al rimborso pieno del prezzo pagato, il bene dovrà essere restituito integro e, comunque, in normale stato di conservazione.
Le sole spese dovute dal consumatore per l’esercizio del diritto di recesso a norma dell’art. 55 del cod. cons. sono le spese dirette di restituzione del bene al Fornitore.
Il Fornitore provvederà gratuitamente al rimborso dell’intero importo versato dall’Acquirente entro il termine di 30 (trenta) giorni dal ricevimento della comunicazione di recesso.
Con la ricezione della comunicazione con la quale l’Acquirente comunica l’esercizio del diritto di recesso, le parti del presente contratto sono sciolte dai reciproci obblighi, fatto salvo quanto previsto ai precedenti punti del presente articolo.

MODALITA’ PER L’ESERCIZIO DEL DIRITTO DI RECESSO
Il diritto di recesso si esercita con l’invio, entro il suddetto termine, di una comunicazione scritta mediante lettera raccomandata con avviso di ricevimento al seguente indirizzo: Les Vedettes di Simona Erba, Via Pelagio Palagi, 5, 20129 Milano o tramite posta elettronica all’indirizzo: simona@ferenclegyek.com
Qualora sia avvenuta la consegna del bene, il cliente è tenuto a restituirlo a Les Vedettes di Simona Erba entro il termine di 15 (quindici) giorni lavorativi decorrenti dalla data di consegna del bene.
Il bene va restituito completo di autentica imballato nei suoi involucri originali.
Al prodotto restituito va unita una copia della ricevuta elettronica dell’ordine.
Le spese di restituzione del bene sono a carico del cliente.
Se il diritto di recesso è esercitato dal cliente conformemente alle disposizioni contenute nella presente clausola, Ferenc Legyek / Les Vedettes di Simona Erba è tenuto al rimborso delle somme versate dal cliente.
In particolare, Ferenc Legyek / Les Vedettes di Simona Erba, procederà gratuitamente alla trasmissione dell’ordine di riaccredito relativo al costo del bene spedito comprensivo delle spese di spedizione entro 30 (trenta) giorni dalla data in cui è venuta a conoscenza dell’esercizio del diritto di recesso da parte del cliente.
Questa operazione verrà effettuata tramite rimborso PayPal ove possibile ovvero accreditando la somma sul conto corrente bancario indicato dal cliente.
Ferenc Legyek / Les Vedettes di Simona Erba ha il diritto di respingere qualsiasi prodotto restituito con modalità diverse da quelle sopra specificate, così come i prodotti per i quali non siano state integralmente pagate dal cliente le spese di restituzione, oppure non siano state rispettate le modalità e i tempi indicati per la comunicazione dell’esercizio del diritto di recesso.

CLAUSOLA RISOLUTIVA ESPRESSA
In caso di mancato pagamento totale o parziale del prezzo di acquisto del bene Ferenc Legyek / Les Vedettes di Simona Erba, si riserva il diritto di dichiarare ai sensi e per gli effetti dell’art. 1456 del codice civile risolto il presente contratto mediante l’invio di una comunicazione scritta all’indirizzo elettronico del cliente.

RECLAMI
Per ogni eventuale reclamo o chiarimento, il cliente dovrà scrivere all’indirizzo di e-mail simona@ferenclegyek.com
Il cliente verrà ricontattato per chiarimenti entro 3 (tre) giorni lavorativi dalla richiesta.

LEGGE APPLICABILE E FORO COMPETENTE
Per le controversie sul diritto di recesso e sui contratti di acquisto stipulati online sarà competente il foro di Milano. RINVIO
Il presente contratto è regolato dalla legge italiana.

TEMPI DI CONSEGNA
Dalla ricezione del pagamento l’opera d’arte sarà consegnata entro 15 / 18 giorni lavorativi.

DELIVERY OF PRODUCTS
